From Mar. 29 to 31, 2010, the MSOD (Master of Science of Organization Development) Project Team of the George L. Graziadio School of Business and Management of Pepperdine University (USA) made the fifth visit to BAC in five consecutive years. BAC’s independent mediation system once again became the research topic of the MSOD Project Team. After the comparative study on US mediation institutions, the study on BAC’s organizational structure and development goal and the interview with BAC’s mediators and staffs, the MSOD Project Team offered its consultation opinions on the development of BAC’s mediation business.
Due to the support and encouragement by the courts, mediation is developing rapidly in the USA at present. Because of its convenience, flexibility and low cost, mediation is greatly welcomed and all kinds of institutions and individuals are offering different kinds of mediation services and accessory mediation trainings in the USA. The development of the US mediation system will be a valuable reference and model for China to develop its mediation system.
The MSOD Project Team reached the conclusion after its research that BAC, as the first arbitration institution in China engaging in the business of independent mediation, keeps up with the international trend and provides relevant parties with diversified dispute resolution services, including arbitration, mediation and engineering dispute review; which is not only good for its long-term development, but also positive measures for the benefit of relevant parties. BAC should make full use of its existing resources, bring into play its potentials, and promote its mediation services thoroughly; at the same time, it should establish a complete training and authentication system, so as to provide relevant parties with a large number of reliable and experienced mediators.
The MSOD Project Team also concluded that BAC is a valuable research object as it has, in the past five years, continuously been tapping on its potentials, always been progressing to the goal of becoming a first-class arbitration institution in the world, and made extraordinary achievements both in its interior governance and its outreach. The development course of BAC provides good materials for the research of the MSOD Project Team and it will keep a long-term cooperation relationship with BAC.
