Secretary General WANG Hongsong Speaks on “East or West--Where to Arbitrate” in London on Invitation

From Jun. 23 to 24, 2010, Secretary General WANG Hongsong participated in the Preferred Firm Litigation Conference sponsored by Berwin Leighton Paisner (BLP) and delivered a speech with Jams Clanchy, Deputy Director General of the London Court of International Arbitration (LCIA), on the same topic of “East or West--Where to Arbitrate” on invitation.

In her speech, Secretary General WANG Hongsong said that the arbitration in China has multiple advantages, including the possibility of applying for property & evidence preservation and the execution of arbitration awards without applying to the courts for recognition, as the choice for the resolution of disputes involving Chinese parties. As the ad hoc arbitration is not recognized by the laws of China on arbitration, Secretary General WANG Hongsong suggested to the participants that an arbitration institution must be clearly chosen when drafting the clauses on dispute resolution in a contract. Secretary General WANG Hongsong also introduced the advantages of BAC in the disposal of international cases, such as internationalized arbitration rules, increasing experiences, unique mechanism for ensuring the institutional independence and justness, low cost, ability to provide diversified dispute resolution services, good interaction with the court system and modern equipment. Mr. Nicholas Fletcher, Director of the International Arbitration Department of BLP, commented that the speech of Secretary General WANG Hongsong is “very interesting indeed and extremely well received”. Mr. John Traylor, another partner of BLP specialized in the international business development, said that “the striking contest between the BAC’s new offices and the old ones arouse one’s association with the rapidly developing international image of China”.
