News Brief of a Forum on How Arbitration Could Serve National Defense Building

On March, 17, 2012, the Beijing Arbitration Commission (the BAC) held a forum on the topic of “How Arbitration Could Serve National Defense Building” in the navy headquarters’ Jinghai Building. 41 cadres, including 3 generals, who have long been involved in military legislation, trial, counsel, and political work, attended the forum. They came from the Four General Departments of PLA China (the Headquarters of the General Staff, the General Political Department, the General Logistics Department, and the General Armaments Department), the categories of troops (the Navy, the Air Force, and the Second Artillery), Beijing Military Region, and the Armed Police.

In the forum, Liao Shenghui, former commissar of Beijing Military Representative Bureau of the General Armaments Department presented a research report on the application of arbitration system by the General Armaments Department in its armaments scientific research and production contracts. The report believed that to apply arbitration to improve legal system building in the armaments sector was an inevitable trend, a proper alternative to strengthen the weaknesses in the current procurement management system, an objective need stemming from the reality that dispute resolution in arms procurement was becoming more and more difficult, a powerful way to better the quality of the parties and standardize ?contracting behavior,, and an effective tool to enhance efficient and healthy military building. Secretary general Wang Hongsong presented arbitration development trend domestically and abroad and the measures taken by the BAC to ensure fairness and justice. Military leaders presented in the forum had heated discussions on how arbitration could serve national defense building. ??

All agreed that to resolve the economic disputes in national defense building between armies and enterprises, and among enterprises through arbitration was not only necessary and feasible, but also far-reaching. Since military cadres knew little about the current arbitration system, it was necessary to make more efforts to spread arbitration and publicize it in the military.

All disputes arising from or in connection with this contract shall be submitted to Beijing Arbitration Commission / Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties.
