Beijing Arbitration Commission

The summit forum of Law of China University of Political Science and Law (CUPL), which was sponsored and co-organized by BAC, was successfully held in the Graduate School of CUPL on the evening of May 19, 2013. The theme of the summit forum was “Judicial Review and Supervision of Arbitration Awards”. The forum was a part of the thesis competition named “New Academics” of CUPL. Many specialists within the industry gathered together and discussed around the theme from the perspectives of theory and practice. Li Xiandong, Professor of CUPL and arbitrator of BAC, presided over the forum. Yang Xiuqing, Professor of CUPL, Fei Anling, Professor of CUPL and arbitrator of BAC, and Liu Junhai, Professor of Renmin University of China and arbitrator of BAC, discussed the establishment of the system for judicial supervision over arbitration awards from a theoretical perspective; while Lv Xin, Deputy Director of BAC, Fan Shuwei, Judge of Civil Court 3 of Beijing First Intermediate People’s Court, and Ge Lei, Director of the Real Estate Business Department of Yingke Law Firm, introduced practical situations of judicial review of arbitration awards respectively from the perspectives of arbitration institution, court and lawyer.

Deputy Director Lv Xin of BAC firstly took BAC as the example to briefly introduce the revocation and the non-enforcement of arbitration awards in recent years and analyze the changes and development brought about by the amendments to Civil Procedure Law; afterwards, he emphatically introduced the system design of BAC to enhance the quality of arbitration awards, including arbitration rules concerning service and other issues, training of arbitrators and vocational study of secretaries.

Judge Fan Shuwei introduced the procedure of the people’s courts to hear the application for an revocation of arbitration award and introduced the causes of revocation provided in the Arbitration Law.

Professor Fei Anling reviewed the development of Chinese arbitration system and talked about the necessity of and restrictions on the supervision of arbitration awards, while Professor Yang Xiuqing raise three conceptions as to perfect the judicial review of arbitration awards. Ge Lei, a lawyer, based on his work experience, shared the feelings of lawyers in participating in arbitration cases. Professor Liu Junhai, conceived a pyramid of dispute resolution and sorted out the relationship between the arbitration institutions and the people’s courts.

Attracted by the forum, dozens of graduate students of CUPL listened to the introduction of the specialists. The specialists obtained positive feedback from students by their speeches that combined their own work experience and practical learning, and received a ready response from the students by their wide vision that is based on the present and looking to the future; meanwhile, the students were interested in the humorous presentation style. The forum came to a successful conclusion with excellent speeches of all honored guests.
