BAC and Singapore International Arbitration Centre Co-organized TMT Arbitration China

    The TMT Arbitration China, co-organized by the Beijing Arbitration Commission (BAC) and the Singapore International Arbitration Centre (SIAC), was successfully held on September 12, 2013 in Four Seasons Hotel, Beijing. More than 100 in-house legal counsels and lawyers from the TMT industry participated in this seminar.

    TMT is a concept developed from combining the Technology, Media and Telecommunications industries. The integration and development of industries always bring about new opportunities and challenges. The seminar explored and analyzed the main legal risks to the TMT industry, the prevention measures and the ways to resolve legal disputes if any. It brought together TMT in-house legal counsels and lawyers from both home and abroad for an in-depth discussion.

    The seminar was chaired by Mr. CHEN Fuyong, Deputy Secretary-General of BAC. Mr. Li Changxi, Director of Regulations Division of the Department of Policies, Laws and Regulations, Ministry of Industry and Information Technology; Ms. Lim Seok Hui, CEO of SIAC; Mr. LIN Zhiwei, Secretary-General of BAC; Gary Born, Partner and Head of International Arbitration Practice Group at Wilmer Cutler Pickering Hale and Dorr LLP, addressed the seminar.

     In his speech, Secretary-General LIN Zhiwei introduced the measures that the BAC has taken to ensure high-quality ADR services to an extensive range of market bodies. The BAC has been following closely the rapid development of emerging industries including the TMT industry and has been exploring various ways of dispute resolution, including arbitration, mediation and dispute review, which would meet the needs of different industries. The BAC is also staffed with a lot of arbitrators who are exports in the TMT industries and has exhibited outstanding professionalism and legal expertise in handling IMT disputes.

    Part I of the seminar was chaired by Mr. LEI Jiang, Partner of KPMG, and Ms. CHEN Lijie, General Counsel of China Mobile; Mr. LI Jinsong, General Counsel of TravelSky; Mr. PAN Boyu, General Counsel of Youku; and Mr. ZHANG Bo, General Counsel of Sony Mobile Communications gave speeches on the risk analysis and exploration of the main legal risks to the TMT industry.

    Part II to Part IV of the seminar focused on the risk management before the event of transaction disputes as well as sharing the experience of TMT dispute resolution. All disputes arising from or in connection with this contract shall be submitted to Beijing Arbitration Commission / Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties.
