On Nov 22 2016, the “Top Tips for International Arbitration: An In-house Training Camp” hosted by the Beijing Arbitration Commission/Beijing International Arbitration Center (the “BAC”) jointly with the Asia-Pacific Forum for International Arbitration (the “AFIA”) convened in the international conference hall of the BAC. More than one hundred attendees, including in-house counsels of large enterprises, attorneys from famous firms and arbitration experts, participated in this event.
The event was moderated by Mr. Arthur Ma, China Representative of AFIA and Partner of DaHui Lawyers. Mr. Lin Zhiwei, Secretary General of the BAC, delivered a welcome speech. Mr. Lin extended warm welcome to all the attendees. He said that the BAC expected that attendees could learn about more practice experience in international arbitration from this event. Meanwhile, he looked forward to further cooperation with preeminent international organizations, by which to promote the BAC’s connection with the international arbitration industry.

Thereafter, Charlie Manzoni QC, the first speaker, made a speech on effective advocacy in international arbitration from the perspective of in-house counsels. Based on an electrical product case that he has been engaged in, he clarified the importance of integrity and courtesy in representing arbitration cases. He stressed that in-house counsels and attorneys must get fully prepared prior to the hearing, including acquaintance with the facts, early preparation of arguments and understanding of the applicable law. He pointed out that only when one gains the trust of the arbitral tribunal can s/he has strong persuasion with his/her arguments and rebuttals. Similarly, only when one trusts the tribunal in his/her case and builds mutual trust therewith can the arbitral proceeding proceeds smoothly that will lead to a positive interaction.

The second speaker was Toby Landau QC, who provided an in-depth analysis as to how to effectively convince the arbitral tribunal in order to win the case. He stressed the importance of the statement of the case during the oral hearing, and pointed out that the points of argument should be concise and vigorous, as far as possible, from which the arbitrators could have a clear mind about the case. At the same time, he took cross-examination as an example and presented vividly and humorously to the attendees how to win the trust of the arbitral tribunal. At last, he highlighted that what should be done is not only to make submission to the arbitral tribunal, but to carefully analyze what the tribunal needs and to endeavor to lead the tribunal to understand and adopt one’s own ideas.

At the end of the seminar, Mr. Arthur Ma moderated the Q&A session where the attendees positively raised questions of particular interest to them. Such questions covered the strengths and weaknesses of international arbitration lawyers, the selection of the seat of arbitration and the like. The two speakers gave detailed answers. Then the seminar came to its end successfully with warm applause of the attendees.
