On the Afternoon of October 31 2018, the seminar themed “International Engineering Dispute Resolution” jointly organized by the Beijing Arbitration Commission / Beijing International Arbitration Center (the “BAC”) and the Dispute Resolution Board Foundation (the “DRBF”) and the cooperation signing ceremony between the BAC and the DRBF were successfully held. The event was moderated by Dr. Chen Fuyong, Deputy Secretary General of the BAC.
In his opening address, Mr. Lin Zhiwei, Secretary General of the BAC, extended his thanks on behalf of the BAC to those who have contributed to the cooperation reached with the DRBF, and said that both the BAC and the DRBF are devoted to the resolution of disputes in a professional and reliable manner, and thus have a solid foundation for cooperation. In their future cooperation, both parties will be complementary to each other in terms of dispute resolution means, professional trainings and information sharing, so as to have extensive cooperation within the engineering industry, make mutual promotion and marketing efforts, and provide the parties with more professional and qualified services. At last, he looked forward to in-depth cooperation with the DRBF based on this signing ceremony, and wished the seminar a fruitful success.

Thereafter, Mr. Kurt Dettman, President of the DRBF, warmly congratulated on the cooperation signing ceremony on behalf of the DRBF in his opening address, and made a brief introduction of the DRBF. The DRBF consists of independent professionals, with the aims of dispute prevention and resolution. It has approximately one thousand members from over 70 countries and regions around the world. The DRBF pays great attention to cooperation with internationally renowned professional organizations, and its signing ceremony with the BAC is a striking example in this respect. Meanwhile, Mr. Dettman expected to conduct future cooperation with the BAC in international engineering dispute resolution, especially concerning the Belt and Road Initiative, where both parties could make mutual progress on a mutual beneficial and complementary basis.

With the joint witness of Mr. Cui Jun, President of Beijing Overseas Junhe Construction Consultation Co., Ltd., and Mr. James Perry, President-elect of the DRBF, as well as the audience, Mr. Lin Zhiwei and Mr. Kurt Dettman signed the cooperation agreement on behalf of the two organizations.

First of all, Mr. James Perry gave a keynote presentation on “DB’s Advantage in Dispute Avoidance/Resolution”. The dispute board exists throughout the engineering project, aiming to avoid disputes and help the parties to resolve disputes. Disputes boards usually fall into two types: standing dispute board and interim dispute board. According to the effectiveness of the dispute board’s decisions and the dispute board’s responsibilities, dispute boards can be further divided into five categories: Dispute Review Board (DRB), Dispute Avoidance/Adjudication Board (DAB/DAAB), Dispute Board (DB), Combined Dispute Board (CDB) and Dispute Resolution Expert (DRE). Dispute boards have a good many practice in international engineering dispute resolution and avoidance, and have achieved positive results, providing significant convenience to the parties. Then Mr. James Perry made a detailed analysis of the advantages of the DRBF in international engineering dispute resolution and avoidance by reference to the practice of dispute boards involved in those major projects in China and countries involved in the Belt and Road Initiative.

Next, Mr. Kang Fei, Doctor of Tianjin University and Post-Doctor of Tsinghua University, provided his keynote presentation themed “Analysis of Chinese International Contracting Development and Dispute Resolution Mechanisms”. He introduced the historical development of Chinese international contracting, and meanwhile clarified the background and features of dispute board, and shared the specific statistics concerning contracting by countries along the belt and road. In addition, he analyzed the causes of international engineering disputes, such as the ambiguity of contract terms, mismanagement, complexity of the project itself and the uncertainty of external environment. By comparing several frequently seen engineering dispute resolution means, he shared his thoughts in this regard.

At last, Mr. Li Zhiyong, Chinese Representative in the DRBF, delivered closing remarks. He congratulated on the successful signing of cooperation agreement between the BAC and the DRBF, and briefly reviewed the background of this seminar and the cooperation process of the two organizations. With the keywords of internationalization, inheritance and emotion, he expressed the expectation and determination as an international engineering practitioner to work with the BAC and the DRBF to jointly promote the development of Chinese international engineering industry. At last, he wished that the cooperation between the BAC and the DRBF could engage international and domestic professionals within the area of Chinese international engineering dispute resolution, learn from the industrial professional experience, stick to the idea of inheritance, keep sustainable growth, and build a more professional and influential environment for the industry.
