BAC Delegation Attended “IPBA Regional Conference 2018” and “IPBA-THAC Arbitration Day”

Between November 5 and 6 2018, the “IPBA Regional Conference 2018” jointly hosted by the Inter-Pacific Bar Association (the “IPBA”) and the EDJ-UDOM & ASSOCIATES and the “IPBA-THAC Arbitration Day” jointly hosted by the IPBA and the Thailand Arbitration Center (the “THAC”) were successfully held in Bangkok. At the invitation of the organizers, the Beijing Arbitration Commission / Beijing International Arbitration Center (the “BAC/BIAC”) dispatched a delegation consisted of its Deputy Secretary General Dr. Chen Fuyong and its Case Manager of International Arbitration Dept. Mr. Lin Chenxi to attend the event.

At the beginning of the event, Mr. Vissanu KREA-NGAM, Vice Prime Minister of Thailand, delivered a speech. Starting from the potential problems of court litigation, he highlighted the significant value of diversified dispute resolution means such as arbitration to the efficient and economical resolution of international commercial disputes in this era of constantly developed globalization and electronic information technology. He incited the arbitration professionals to proactively seek the development of international arbitration, and continue to contribute to the prosperity of international investment and trade.

Dr. Chen Fuyong was invited to deliver a speech in the panel discussion on “Recent Legislative and Case Law Developments in Arbitration in Asia”. With reference to judicial interpretations issued by the PRC Supreme People’s Court (the SPC), Dr. Chen presented an introduction of the efforts and explorations of PRC courts and arbitration practitioners in the promotion of Chinese arbitration development. Firstly, he unveiled the status quo of constant growth and prosperity of the Chinese arbitration market based on the statistics of caseload filed with Chinese arbitration institutions and arbitration related judicial review by courts. He pointed out that under the existing PRC Arbitration Law, the SPC judicial interpretations are of great practical significance to the support for arbitration and the attraction of international arbitration practitioners’ participation in Chinese arbitration. Meanwhile, Dr. Chen introduced the adoption of general international rules in terms of the language and seat of arbitration in the BAC Arbitration Rules, as well as the latest international arbitration practice such as emergency arbitrator procedure, and thereby highlighted the profound understanding of those advanced ideas of international arbitration and the persistent pursuit of first class arbitration administration services by Chinese leading arbitration institutions represented by the BAC. The panel discussion was moderated by Mr. Lars MARKERT, Partner of Nishimura & Asahi from Japan, and Mr. Robert RHODA, Partner of Bird & Bird Hong Kong Office. Other panelists included Mr. Doo-Sik KIM, Senior Partner of SHIN&KIM from South Korea, Mr. Ko Luen LAM, Head of Construction Dept. of SHOOK LIN & BOK from Malaysia, and Ms. Swee Yen KOH, Partner of WONG Partnership from Singapore, who also provided introduction of the latest practice concerning legislation and case in their respective countries.

On the morning of November 6, the BAC delegation paid a visit to DTL Law Office. Director of DTL Law Office Mr. Shi Datuo introduced the development of the firm as the first law firm established in Thailand by Chinese. Dr. Chen sincerely appreciated DTL Law Office’s services to Chinese enterprises overseas. He introduced the BAC’s efforts in building a Sino-foreign platform for legal exchange based on its Commercial Dispute Resolution in China: An Annual Review and Preview series and overseas roadshow events thereof, and expected Chinese legal practitioners overseas could strengthen their connection and exchange with Chinese domestic arbitration institutions, and jointly promote the globalization of the Chinese legal service industry.

On the afternoon of November 6, the BAC delegation paid a visit to the THAC. Representatives of the THAC introduced its caseload and management since its establishment. Dr. Chen shared the BAC’s growth experience over the past two decades, in particular those beneficial explorations in institutional innovation and development strategy in its early days. Both parties also had exchange of views on having closer cooperation and building an exchange platform for the dispute resolution professionals of the two countries.

The BAC has been endeavored to promote the exchange between the Chinese arbitration community and international practitioners, to build an exchange platform and to enhance the mutual understanding and trust. The BAC is also willing to provide a platform and support to people with insight who works on the promotion of Chinese arbitration development, and jointly promote the development and reform of the Chinese arbitration.

All disputes arising from or in connection with this contract shall be submitted to Beijing Arbitration Commission / Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties.
