On 26th January, 2019, The 2018 Work Report Meeting of Beijing Arbitration Commission/Beijing International Arbitration Center (“BAC/BIAC”) was successfully held in the BAC/BIAC’s international conference room. Mr. Huixing Liang, Chairman of BAC/BIAC, Mr. Hongsong Wang, Vice-chairman of the BAC/BIAC, Mr. Pizhao Che, committee member of the BAC/BIAC, Mr. Jinglian Duan, Vice Inspector of Legislative Affairs Commission of the National People’s Congress Standing Committee, Mr. Hai Shi, Director of Public Legal Service Bureau of Ministry of Justice, together with arbitrators and staff members of the BAC/BIAC, participated in the meeting. This meeting was moderated by Mr. Pizhao Che.

Mr. Zhiwei Lin. Secretary Gemeral of the BAC/BIAC, summarized and reported 2018 annual work from following respects:
In 2018, BAC/BIAC registered 4,872 cases which mounted to 75.155 billion. The average case amount of more than 100 million reached 370 million. In domestic cases, there are 2,942 cases in which one party or two parties are from other provinces, accounting for 61.50% of domestic cases, an increase of 859 cases and 41.24%. There are 810 cases in which both two parties are from other provinces, accounting for 16.93% of domestic cases, an increase of 241 cases and 42.36%. The caseload and case amount that applies international commercial arbitration proceeding is continually increasing, which is 88 and 4.681 billion respectively. There are also several cases that applies foreign law, other language or other arbitration rules. BAC/BIAC not only maintains its influence in China but also continues to improve its international reputation.
Due to the cases growth rapidly, there were 4,125 cases closed in 2018. A year-on-year increase of 607 cases and 17.25% respectively. The average amount of time of closed cases from registration to closing is 136.73 days, from forming the arbitral tribunal to closing is 82.25 days. BAC/BIAC closed 3,377 cases in total in 2018. As for the nomination of arbitrators, arbitrators from or out of Panel of Arbitrators have participated the handling of cases for 6,888 times. Among them, there are 368 arbitrators who are listed in the Panel of Arbitrators and there are more than 95% domestic arbitrators participating in arbitration proceedings. And there are 10 foreign arbitrators participating in arbitration proceedings in 2018. BAC/BIAC positively promotes the application of Recommended List Procedure and improves the percentage of parties’ selection of arbitrators. In 2018, the percentage of closing by arbitral award, mediation and withdrawal is 61.75%, 15.30% and 19.73 respectively. There is no arbitral award that is revoked and there are only 3 arbitral award that is not enforced in 2018. Owing to the correct leadership of committee and unremitting efforts of arbitrators and staff, BAC/BIAC will continue to provide independent and high-efficient services for parties.
It is worth mentioning that subject to the changes of economic environment and policy, there is a clear growth trend of finance-related cases. BAC/BIAC takes the initiative to adjust internal working mechanism and establish specialized departments in charge of exploring, advertising and researching subject to features and requirements of different industries and international disputes. These explorations build experience sharing platform and help all kinds of market players, regulatory bodies and associations to improve the ability of identifying and preventing risks, improve arbitrators’ and lawyers’ ability of arbitration and strengthen BAC/BIAC’s influence.
In 2018, BAC/BIAC launched and participated in 190 exploring activities including delivering speeches in ICCA, attending UNCITRAL Working Group Meeting as observer and organizing Summits on Commercial Dispute Resolution in China. BAC/BIAC also signed cooperation agreement with several industry associations, embassies and consulates and international dispute resolution institutions. Based on comprehensive research work, BAC/BIAC launched more than 20 exploring activities in Beijing. What’s more, BAC/BIAC continued to publish books such as “Beijing Arbitration” and “Annual Review on Commercial Dispute Resolution in China” and also carries out translation series, scientific research fund, papers contest and all kinds of Chinese and English newsletter, which keep spreading Chinese arbitration experience and BAC/BIAC’s excellent practices.
As for internal construction, BAC/BIAC put emphasis on the reasons of long-pending cases and complaint cases and focuses on the supervision of arbitration proceedings and review of the enforcement of standard specifications. BAC/BIAC applied institutionalized and systematized incentive and punishing measures to improve the working competence of arbitrators and secretaries.
Mr. Zhiwei Lin emphasized that BAC/BIAC would still take the quality and efficiency of cases as a key point and implement the responsibilities of arbitration institutions provided by Arbitration Law, promote the development of arbitration industry and improve its competitiveness.

After that, Mr. Qiming, Chen, Director of Beijing Hanwen Law Firm, shared his experiences with BAC/BIAC and expressed congratulations on BAC/BIAC’s achievements. He believed the core competitive power of“Independence, Justice, High-efficiency and Professionalism” will help BAC/BIAC to become international top-ranking arbitration institution.
Ms. Xiaoming Li, former General Counsel of PetroChina International Co., Ltd, shared her thoughts of case handling. She believed that arbitrators shall keep learning and correct their attitude toward solving disputes for parties, take partners’ advice, prepare and advance every hearing. She pointed out that it is the responsibility of every BAC/BIAC’s arbitrator.
Ms. Yuxiu Qin, General Counsel of China State Construction Engrg. Corp. Ltd thought highly of BAC/BIAC’s achievements in building credibility. She shared cases that enterprises choose and recognize BAC/BIAC. She attached great importance on sticking to independence and justice, respecting parties’ autonomy, providing high-efficient and professional services.

Mr. Liang firstly affirmed BAC/BIAC’s achievements in 2018 and pointed out the developing direction of BAC/BIAC’s arbitrators and staff:
Firstly, the development quality of BAC/BIAC is closely related to the improvement of internal institution and changes of external environment. In recent years, the establishment and enforcement of several institutions greatly improve the standards degree of BAC/BIAC and takes the advantage of external environmental changes. The committee will further focus on the research and planing of BAC/BIAC’s long-term goal and the supervision and evaluation of case handling in order to improve BAC/BIAC’s credibility.
Secondly, whether or not BAC/BIAC depends on the overall development of socialism with Chinese characteristics successfully? Each case shall be arbitrated fairly so that socialist market economy will be promoted, which is exactly what BAC/BIAC can do.
Thirdly, BAC/BIAC’s team shall stick to professional dignity. Excellent qualities, moralities and shall be inherited by arbitrators and secretaries.
At the end of the speech, Mr. Liang expressed good wished of Chinese New Year.
