Beijing Arbitration Commission

On the afternoon of December 10 2019, the Beijing Arbitration Commission / Beijing International Arbitration Center (the “BAC”) and the Beijing Intellectual Property Right Protection Center signed a Strategic Cooperation Framework Agreement. Mr. Lin Zhiwei, Secretary General of the BAC, Mr. Zhang Haoliang, Director of the BAC Business Development (International Case) Division, and Mr. Yin Tong, Counsel of the BAC, attended the signing ceremony. Mr. Pan Xinsheng, Deputy Director General of Beijing Municipal Intellectual Property Office, Mr. Chen Jun, Deputy Director of Intellectual Property Coordination Division of Beijing Municipal Intellectual Property Office, Mr, Zhan Hui, Ms. Wang Jin and Ms. Gu Haiyan, BAC arbitrators, and more than twenty representatives of technology enterprises and industrial experts witnessed this signing ceremony.

Mr. Lin Zhiwei, Secretary General of the BAC, and Ms. Hao Qing, Director of the Beijing Intellectual Property Right Protection Center, signed the Strategic Cooperation Framework Agreement on behalf of the two institutions. According to the Agreement, both parties will establish cooperation mechanisms on mediation and commercial arbitration, jointly conduct mediation and arbitration trainings and research projects, and hold diversified dispute resolution mechanism marketing events. Based on close cooperation, the two parties will jointly provide professional arbitration and mediation services to resolve IP disputes arising from the new generation of information technology and high-end equipment manufacturing industry, so as to improve the IP protection level and promote the healthy development of the new generation of information technology and high-end equipment manufacturing industry.

Following the signing ceremony, Mr. Zhang Haoliang, Director of the BAC Business Development (International Case) Division, Ms. Li Muzi, Depputy Director of the Beijing Intellectual Property Right Protection Center, and Mr. Feng Zhongmin, Deputy Director of Beijing Intellectual Property Right Aiding Center, introduced their works and latest practice concerning IP arbitration and mediation on behalf of their respective institutions. During the panel discussion, Mr. Zhan Hui, Mr. Wang Jin and Ms. Gu Haiyan, BAC arbitrators, provided answers from different perspectives of judge, arbitrator and arbitrator to the attendees’ questions on hotspots of IP arbitration and mediation, such as the arbitrability of IP infringement and affirmation disputes, arbitration of disputes over Standard Essential Patent royalty, choice of litigation and arbitration in enterprises’ contract management and the standards of punitive damange in infringement cases.
