On the afternoon of September 9 2022, the Launch Event of Annual Review of International Investment Arbitration in China (2022) was successfully held. As a component of the 16th Symposium on International Investment Law, the event was hosted by the Chinese Society of International Economic Law, supported by the Department of Treaty and Law of PRC Ministry of Commerce, held by the International Law Institute of Xiamen University, Chen An Foundation of Xiamen University and the Research Centre for the Settlement of Investment Disputes at Xiamen University Law School, and was organized by Beijing Arbitration Commission / Beijing International Arbitration Center (the “BAC”) jointly with Secretariat of Maritime Silk Road Central Legal District and Global Law Office.
The event was moderated by Dr. Chen Fuyong, Deputy Secretary General of the BAC. He presented an introduction of the BAC’s new developments in the area of investment arbitration since the BAC Rules for International Investment Arbitration was released in 2019, and stressed that this was the third year the BAC organized the composition of the annual review on international investment arbitration, and the BAC was confident to keep working on this annual review series, so as to meet the expectation of professionals within the area.

In the first session of the event, Prof. Chi Manjiao and Mr. Ren Qing, authors of Annual Review of International Investment Arbitration in China (2022) and arbitrators of the BAC, presented an introduction of the Annual Review from six perspectives, on Latest Practice of Investment Treaties China Concluded, China and Investment Dispute Settlement, Significant Chinese Legislation on Foreign Investment, Resolution of Domestic Disputes related to Investment Disputes, China and ISDS Reform, Participation of Chinese Arbitration Institutions, Arbitrators and Lawyers in Investment Arbitration, with a focus on Chinese legislation and practice on international investment.

In the second session of the event, Ms. Liang Danni, Associate Professor of Sun Yat-sen University School of Law, and Ms. Sun Jiajia, Partner of W & H Law Firm, provided comments on the Annual Review. Ms. Liang started with Chinese Practice in the Development of International Investment Arbitration, and shared her comments on the Annual Review. Ms. Sun gave her comments and analysis on the Annual Review from the perspective of Opportunities of non-ICSID Investment Arbitration – Reviewing from Investment Arbitration Cases.

The BAC has always stuck to its values of independence, impartiality, professionalism and excellence, and has endeavored to provide diversified dispute resolution services to parties both domestic and abroad. In recent years, the BAC paid close attention to, and made continuous research on, the frontline issues of investment arbitration. It has consecutively released the BAC Rules for International Investment Arbitration, the BAC Panel of Arbitrators for International Investment Arbitration, Codes of Arbitrators for International Investment Arbitration and Interpretation of BAC Rules for International Investment Arbitration, aiming to provide potential users of investment arbitration, both domestic and abroad, with a new platform for settling investment disputes that can better meet their needs, by means of close connection between the rules and the arbitration institution.
