On 28 December 2023, the Third China Arbitration Credibility Survey press conference and the Third Arbitration Credibility Forum was held in Beijing. Beijing Arbitration Commission / Beijing International Arbitration Center (the “BAC”) has repeatedly been awarded the prizes of the "Top Ten National Arbitration Institutions" and "Top Ten Arbitration Institutions for Foreign-Related Arbitration Services", with scores ranking the second and the third respectively. In addition, as recorded in the Arbitration Credibility Report, BAC has been selected as the “Arbitration Institution that Arbitrators Mostly Expect to Be Empanelled”.
BAC awarded the "Top Ten National Arbitration Institutions"
The Arbitration Credibility Survey is an independent third-party research and assessment project launched by the China Arbitration Institute of China University of Political Science and Law. The project aims to evaluate the credibility of Chinese arbitration institutions by means of quantitative assessment, in accordance with evaluation metrics considering the arbitration institutions’ arbitration rules, case administration, constitutions of arbitral tribunal, case managers, quality of arbitral awards and participation in social services, and with the evaluation benchmarks of party autonomy and the impartiality, fairness, professionalism and legitimacy of arbitration. BAC was awarded the "Top Ten National Arbitration Institutions" and the "Top Ten Arbitration Institutions for International Arbitration Services" last time in the Second China Arbitration Credibility Survey. Its repeat winning of the double “Top Ten” not only represents arbitration users’ high recognition of BAC, but also reflects the industry’s full affirmation of BAC’s persistence of the value of building arbitration’s credibility and achievements over the years.
BAC awarded the "Top Ten Arbitration Institutions for Foreign-Related Arbitration Services"
Mr. Guo Wei, the Chairperson of BAC, was present at the Conference and delivered a speech. He said that the BAC has always integrated its development with the goal to establish and promote arbitration credibility. In accordance with the requirements of Beijing municipal government, the BAC has earnestly implemented the Opinions on Improving Arbitration Mechanism and Enhancing Arbitration Credibility (the “Opinions”) released by the General Office of the State Council, and has preliminarily completed its structural and institutional reform, with the establishment of a governance mechanism consisting of separated powers of decision-making, execution and supervision, as well as balance and reciprocity of these powers. In addition, the critical determinants that underlie the foundation and guarantee of arbitration institutions’ credibility are the group of qualified arbitrators and staffs of arbitration institutions, BAC therefore will further improve the recruitment and admission of arbitrators and the professionalism of case managers, strengthen the training and professional development of the groups of arbitrators and case managers, and persistently fulfill its initial aspiration and mission of promoting arbitration credibility.
Ever since its establishment in 1995, BAC has always stuck to its values of “independence, impartiality, professionalism efficiency and excellence”, and has always deemed arbitration credibility as the fundament and lifeline of its existence and development. Accordingly, the BAC has perceived arbitration credibility as the value orientation and guidance of target to continually make efforts on the arbitration rules, the administration of arbitration cases, the building of the team of arbitrators and the cultivation of case managers. BAC will take The China Arbitration Credibility Survey this year as an opportunity to carefully analyze the data and conclusion stated in the report, to adopt those useful comments with reference to the credibility evaluation metrics, to further improve BAC mechanism, to optimized the arbitration users satisfaction, to persist on the development its credibility, and to contribute to the healthy development of the Chinese arbitration industry.
A Brief Introduction of China Arbitration Credibility Assessment Project
China Arbitration Credibility Survey is a project initiated by the China Arbitration Institute of China University of Political Science and Law, it is so far the only national academic program on the evaluation of arbitration credibility. It aims to assess the construction of credibility of Chinese arbitration, to evaluate the overall status of arbitration services primarily provided by arbitration institutions, to reflect market trust and confidence in arbitration, to record the real track of arbitration development, and to provide academic support and reference for the regulation and promotion of sustainable development of arbitration.
The preparation of the Third China Arbitration Credibility Survey was started in 2020. Based on the First and the Second projects, this third Project is grounded on the new development and new prospects of Chinese arbitration, with specific reference to the Opinions. According to the new requirements of the reform and development of Chinese arbitration, both the evaluation metrics and the assessment methodology have been further improved. In July and August 2023, over 300 researchers have been selected to conduct on-site surveys in more than 70 arbitration institutions located in over 70 cities across the country. They also visited more than 1 000 law firms and enterprises to have in-depth surveys, by which 13 954 survey questionnaire and interview records have been collected and applied for quantitative analysis. All these efforts contribute to the Third China Arbitration Credibility Survey Report, which has won high recognition of the National People’s Congress, the Supreme People’s Court, the Ministry of Justice and other national authorities of PRC, and has received wide attention and favorable comments from the legal practicing industries both domestically and internationally.
