BAC/BIAC Secretary General Dr. Jiang Lili Led A Delegation to Attend the UNCITRAL Commission in the United States

The 57th session of the UNCITRAL Commission will be held from June 24 to July 12, 2024 at the UN Headquarters in New York, USA. The Beijing Arbitration Commission/Beijing International Arbitration Center (BAC/BIAC) is invited to attend the session of the Commission session as an observer and to provide professional opinions and suggestions on some of the topics.  In accordance with the agenda of this session, the BAC/BIAC formed a delegation, led by the Secretary-General Dr. Jiang Lili, including the Committee Member Dr. Jin Hui, the Arbitrator Ms. Lyu Qi, the Division Chief Ms. Wu Wendi and Mr. Sun Yu, and the Case Manager Ms. Zhao Hanqing to attend the conference. The BAC/BIAC delegation will participate in relevant meetings of Working Group I (Warehouse Receipts), Working Group II (Dispute Settlement), and Working Group IV (Electronic Commerce) in batches.

The consideration of the Draft Model Law on Warehouse Receipts and guide to enactment has been preliminarily completed. The warehouse receipt transaction plays as an important instrument in the field of commercial circulation and supply chain financing, offering the advantages of one-time inspection with multiple endorsements, reducing cargo damage, and saving time and costs in negotiations in international trade. Additionally, it is also a common area of commercial and financial disputes, being a frequent type of case and the growth of disputes in both international and domestic arbitration. This session discussed the opinions of representatives from various countries, including China, on the Draft Model Law on Warehouse Receipts, as well as the Reports of Working Group I on the work of its fortieth and forty-first sessions. The discussion covered the scope of application, definitions, forms, and electronic warehouse receipts. The BAC/BIAC delegation members Ms. Lyu Qi and Ms. Wu Wendi participated in the session on this topic.

In the subsequent agenda of the conference, the BAC/BIAC delegation will continue to participate in the meetings of Working Group II (Dispute Settlement) and Working Group IV (Electronic Commerce). While attending the Commission session, the delegation will also visit international dispute resolution institutions, including the American Arbitration Association (AAA) and JAMS, and other law firms in New York. These researches and exchanges aim to explore the cooperation and development in international arbitration, to promote the latest developments of the Beijing International Commercial Arbitration Hub, and to actively foster international exchange and cooperation in the field of arbitration and dispute resolution.

All disputes arising from or in connection with this contract shall be submitted to Beijing Arbitration Commission / Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties.
